Agreement to terms
By accessing or using the heyRosie service ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service. We may modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
Description of service
heyRosie is an AI-powered memory preservation platform designed to help families capture, organize, and preserve meaningful moments. The Service includes features for storing photos, voice recordings, and written memories, as well as AI-assisted tools for organizing and rediscovering content.
Account registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Your content
You retain all ownership rights to the content you upload, create, or store through the Service ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely to provide the Service to you.
You represent and warrant that you have the right to upload and share Your Content, and that Your Content does not infringe on the rights of any third party or violate any applicable laws.
Acceptable use
You agree not to use the Service to:
- Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Impersonate any person or entity or misrepresent your affiliation
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers

Subscription and payments

Termination

Upon termination, you may request export of Your Content within 30 days, after which it will be deleted.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of San Francisco, California.
